§ 1 Contractual partner

§ 2 Scope of application

These terms and conditions apply to all trades originating from a purchase from Level Audio (see § 1) to consumers. A consumer is any natural person acting for purposes outside any trade, business, craft or profession they may carry on (Art. 3(1)(a) of the Italian Consumer Code, Legislative Decree No. 206 of 6 September 2005).

For borrowing equipment under the “Try at home” programme, the conditions on the Try at home page apply in addition.

§ 3 Conclusion of contract

These terms and conditions apply to orders that a consumer places on the website levelaudio.it. The sales contract is concluded with Level Audio. The presentation of the products in the online store does not constitute a legally binding offer, but only an invitation to order. By clicking the button “Order with obligation to pay” you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation by e-mail immediately after receiving your order.

Level Audio stores the order details. The order confirmation that consumers receive by e-mail contains the order details. The order details can also be viewed online: in the customer account (order history) or, for orders placed as a guest, via guest order tracking. The current version of these terms and conditions is always available on this page and can be saved and printed when placing an order. Level Audio does not store the version of these terms and conditions in force at the time of the order separately for each order.

Before submitting the order, consumers can check and correct their entries at each step of the checkout and change the contents of the shopping cart. The contract can be concluded in English, German or Italian.

§ 4 Payment

The prices stated are final prices and include statutory VAT, which is shown separately on the invoice. For deliveries to the United Kingdom and the United Arab Emirates (export deliveries), no Italian VAT is charged and the price excluding VAT applies. Import VAT, customs duties and other import charges in the country of destination are borne by the consumer. Shipping costs are not included in the displayed price and may be charged in addition.

Unless otherwise agreed, the payment options available to consumers include the following:

§ 5 Delivery

Delivery takes place within the European Union typically within 3–4 business days, and to the United Kingdom and the United Arab Emirates typically within about one week, unless the product description states otherwise. Current shipping times and costs are listed on the “Shipping & Payment” page.

For payment by bank transfer, this period begins on the day after the consumer gives the transfer order to their bank; for all other payment methods (e.g. credit card, PayPal, Apple Pay, Google Pay), it begins on the day after the contract is concluded.

§ 6 Transfer of risk

The risk of loss or damage to the shipped goods is ours during the time of transit. It transfers with delivery of the goods to the recipient.

§ 7 Retention of title

Until full payment, the goods remain our property.

§ 8 Warranty

The statutory warranty provisions (legal guarantee of conformity) apply. An overview of your rights under the legal guarantee can be found on our Legal guarantee page.

§ 9 Liability

Level Audio is liable to consumers in accordance with the statutory provisions.

These terms and conditions neither exclude nor limit Level Audio's liability. This also applies to the statutory warranty (§ 8) and to liability under product liability law.

§ 10 Data protection

Information on the collection, processing and use of consumers' personal data can be found in our Privacy Policy.

§ 11 Out-of-court dispute resolution

We are not obliged, either by law or by a voluntary commitment, to take part in alternative dispute resolution proceedings before a consumer ADR body. If a complaint cannot be resolved directly with us, we will tell you which ADR body is competent and whether we will take part in proceedings before it.

You can send complaints to shop@levelaudio.it. Your right to bring the matter before the competent courts remains unaffected in all cases.

§ 12 Applicable law, place of jurisdiction

The law of the Italian Republic applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected where they grant the consumer more extensive protection than the law of the Italian Republic.

No special place of jurisdiction is agreed with consumers; the statutory rules on jurisdiction apply. Under these rules, a consumer domiciled in a Member State of the European Union can be sued by Level Audio only in the courts of that State, and may sue Level Audio either in the Italian courts or in the courts for the place where the consumer is domiciled (Art. 18 of Regulation (EU) No 1215/2012). If the consumer's residence or domicile is in Italy, the court of that place has jurisdiction (Art. 66-bis and Art. 33(2)(u) of the Italian Consumer Code).

§ 13 Severability

Should individual provisions of these terms and conditions be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.
